These Terms of Use ("Terms") govern your use of the WordCross mobile application and related website (collectively, the "Service") provided by ZenByte App Agency ("we," "us," or "our"). By downloading, accessing, or using the Service, you agree to these Terms.
1. Eligibility
You must be legally capable of agreeing to these Terms. If you are below the age of legal majority where you live, you may use the Service only with permission and supervision from a parent or legal guardian. The Service is not directed to children under 13.
2. The Service
WordCross is an educational word-puzzle game that presents clues, answers, levels, progress systems, optional hints, and related game features. The Service is intended for entertainment and informal vocabulary practice. It is not a school, language-certification provider, professional tutor, or guarantee of a particular learning result.
3. License
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to install and use the App on devices you own or control, solely for personal, non-commercial use and in accordance with the applicable app-store rules.
4. Acceptable use
You agree not to:
- Copy, sell, sublicense, rent, distribute, or commercially exploit the Service except where law permits.
- Reverse engineer, decompile, bypass, tamper with, or interfere with security, advertising, analytics, rewards, or game systems except where such restriction is prohibited by law.
- Use automation, exploits, modified clients, or fraudulent methods to obtain coins, hints, rewards, progress, or ad benefits.
- Upload or introduce malware, abusive traffic, or code intended to disrupt the Service.
- Use the Service in violation of law or the rights of others.
5. Game progress and virtual items
Stars, coins, hints, lives, streaks, unlocked levels, and similar items are game features with no cash value. They are licensed, not sold, and cannot be exchanged for real money. We may rebalance, modify, add, or remove game content and virtual items when reasonably necessary. Local progress may be lost if you uninstall the App, clear its storage, change devices, or experience device failure, unless a separate synchronization feature is provided.
6. Advertising and rewarded ads
The free version may display advertising through Google AdMob or other disclosed providers. Some optional rewards may require watching a rewarded advertisement. Ad availability, format, and reward eligibility can vary by region, device, network connection, provider inventory, age status, consent choice, and technical conditions. We do not guarantee that an ad or reward will always be available. Attempts to manipulate ad delivery or rewards may result in rewards being withheld or local progress being reset where permitted.
7. In-app purchases
If paid features or purchases are introduced, transactions will be processed by Apple, Google, or the relevant app store, not directly by us. Prices, taxes, billing, refunds, subscriptions, and cancellation are subject to the store's terms. Unless required by law or platform rules, we cannot independently issue refunds for transactions controlled by the store. The App's store listing and purchase screen will describe the applicable product before purchase.
8. Intellectual property
The Service, including its code, design, artwork, interface, logo, levels, original clue wording, audio, and branding, is owned by or licensed to ZenByte App Agency and protected by applicable intellectual-property laws. English and Turkish words themselves remain part of the language and are not claimed as exclusive property.
9. Feedback
If you send ideas, suggestions, or feedback, you grant us permission to use them without restriction or compensation, while you retain ownership of any rights you may already have.
10. Third-party services
The Service may rely on third-party platforms and SDKs, including Apple, Google Play, Firebase, and AdMob. Their services may be subject to separate terms and may occasionally be unavailable. We are not responsible for third-party services beyond the extent required by law.
11. Updates and availability
We may update, suspend, discontinue, or change the Service or any feature. Updates may be required for continued use. We do not guarantee uninterrupted availability, compatibility with every device, or that every error will be corrected.
12. Disclaimer
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, accuracy, or specific educational outcomes. Nothing in these Terms excludes rights that cannot legally be excluded.
13. Limitation of liability
To the maximum extent permitted by law, ZenByte App Agency will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, lost progress, or business interruption arising from the Service. Where liability cannot be excluded, our total liability will be limited to the greater of the amount you paid for the Service during the previous twelve months or the minimum amount required by law.
14. Indemnity
Where permitted by law, you agree to indemnify us against claims, losses, and reasonable costs arising from your unlawful misuse of the Service or violation of these Terms.
15. Termination
You may stop using the Service at any time by uninstalling it. We may restrict access when reasonably necessary to protect users, the Service, third parties, or legal compliance, particularly in cases of fraud, abuse, or material violation of these Terms.
16. Governing law and disputes
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply. Courts with lawful jurisdiction in Türkiye will have jurisdiction, unless applicable consumer law gives you the right to bring a claim elsewhere.
17. Apple-specific terms
If you use the iOS version, you acknowledge that these Terms are between you and ZenByte App Agency, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you to the extent permitted by the App Store rules.
18. Changes
We may revise these Terms. The updated version will show a new effective date. Continued use after an update means acceptance where permitted by law; material changes will receive additional notice when required.
